On April 18, 2024, Higgins announced The Safeguarding American Workers Benefit Act. On his website he claims that “Congressman Clay Higgins (R-LA) introduced the Safeguarding American Workers’ Benefits Act, which, according to the Congressional Budget Office (CBO), would save taxpayers $24.5 billion by closing a loophole that allows individuals without proper work authorization, including illegal aliens, to claim federal tax credits.
Under current law, those with an Individual Tax Identification Number (ITIN), including illegal aliens, can receive Child Tax Credit (CTC) or Earned Income Tax Credit (EITC) benefits. The Safeguarding American Workers’ Benefits Act would require those applying for the CTC or the EITC to have legally immigrated to our country and have been issued a work-authorized Social Security Number. This ensures that these tax credit benefits go to support legal, working adults and families. Senator Cindy Hyde-Smith (R-MS) introduced companion legislation in the Senate.

However, The Safeguarding American Workers Benefit Act is a BIG lie. Immigrants with Individual Taxpayer Identification Numbers (ITINs) face significant barriers to accessing certain tax benefits designed to support families. Specifically, children with ITINs do not qualify for the Child Tax Credit (CTC) or the Additional Child Tax Credit (ACTC). For a child to be a qualifying dependent eligible for these credits, they must have a valid Social Security Number (SSN). This exclusion means that many immigrant families, who diligently pay taxes using ITINs, are unjustly denied crucial financial support that could help with the costs of raising children.
Furthermore, immigrants using ITINs are also ineligible for the Earned Income Tax Credit (EITC), a benefit aimed at providing financial relief to low- and moderate-income working families. It is deeply concerning and frankly absurd that 30 representatives are promoting legislation that misleads the public about the realities facing immigrant families. These actions not only perpetuate misinformation but also undermine efforts to create a fair and equitable tax system. It is imperative that we advocate for policies that genuinely support all hardworking families, regardless of their immigration status.
If elected, I will not waste time on legislation designed to mislead constituents. My focus will be on creating and supporting policies that address real issues and provide meaningful benefits to our community. We deserve honest leadership that prioritizes the needs of all residents, including immigrant families who contribute significantly to our society. Together, we can build a fairer, more inclusive future.
