On April 18, 2024, Congressman Clay Higgins introduced the Safeguarding American Workers’ Benefits Act, claiming it would save taxpayers $24.5 billion by preventing individuals without work authorization from claiming federal tax credits. The legislation would require applicants for the Child Tax Credit (CTC) and Earned Income Tax Credit (EITC) to have legally immigrated to the United States and possess work-authorized Social Security numbers. Senator Cindy Hyde-Smith introduced companion legislation in the Senate, with Higgins receiving support from 30 original co-sponsors.
However, critics argue that the legislation misrepresents the existing restrictions on immigrant families. Children without valid Social Security numbers are already ineligible for the CTC and Additional Child Tax Credit, while individuals filing with Individual Taxpayer Identification Numbers (ITINs) generally cannot claim the EITC. Opponents contend that the bill promotes misinformation rather than addressing genuine economic challenges faced by working families. If elected, I will prioritize honest leadership and meaningful policies that support our communities, promote fairness in the tax system, and recognize the contributions of hardworking families, regardless of their immigration status.
